Texas Disability Law - Mental Retardation Protections
- Provides that facility residents with mental retardation have the right to medical and dental treatment, fair compensation for labor, humane physical environment, communication and visitation. Residents also have the right to own personal property and due process of the law in issues of guardianship.
- Provides that individuals with mental retardation have the right to live at home or in residential facilities where they can receive training toward the goal of reaching their maximum potential in the least confining manner.
- Provides for protection from exploitation and abuse of individuals with mental retardation.
- Provides individuals with mental retardation the right to participate in all areas of planning.
- Prohibits the use of certain restraints and seclusion techniques and provides whistleblower protections
