Consultant Instructions
Notification Requirements
Government Code, Chapter 2254, Subchapter B, states that agencies may use private consultants only if:
- there is a substantial need for the services; and
- the agency cannot adequately perform the services with its own personnel or through an interagency contract.
Agencies are required to notify the Governor's Office of Budget and Planning (GOBP) and the Legislative Budget Board (LBB) before entering into a major consulting services contract. (Government Code, Section 2254.028) The notification requirements are intended to demonstrate compliance with these conditions and the other policies of this section.
Notification Format
The Governor's Office of Budget and Planning (GOBP) has developed the accompanying format to facilitate uniform notification regarding planned consultant use. The proof of substantial need is central to GOBP's fact-finding responsibilities, so complete and accurate use of this format is important. The following instructions are provided to assist agencies in completing this form (copy attached).
20-Day Publication/Notification
Within 20 days after agencies engage a consultant under contract, the following information should be published in the Texas Register, according to Government Code, Section 2254.030:
- a description of the work to be performed under contract;
- name and address of the consultant selected;
- the amount of the contract; and
- dates for completion of work to be performed.
As soon as the above information is submitted to the Secretary of State for publication, copies should be forwarded to the LBB and GOBP. The copies should make reference to the original contract number as identified in Section 2 of the Consultant Contract Notification Form.
Additionally, the LBB receives notifications, in a form
prescribed by the LBB, no later than the 10th day after an
agency or institution of higher education enters into a
contract over $14,000. This requirement is delineated in
Article IX, Section 9-7.05 of the General Appropriations Act.
